Abstract

يعالج البحث موضوعاً حيوياً يتعلق بنشاط (المؤسسة العامة للمناطق الحرة) ذات الخصوصية لاستثمارية التنموية.  فالمناطق الحرة عموماً هي بوابات عبور للاقتصادات الوطنية، وتشكل مراكز جذب للاستثمارات ونواةً لتحريض تنمية بعض القطاعات الاقتصادية الوطنية, وهي تعتبر من الناحية الجمركية بحكم "الأرض الأجنبية" وبالتالي يحكم عمل المشاريع القائمة فيها المنافسة العالمية واقتصاد السوق كونها تعمل في إطار تشريعات (استثنائية خاصة) تتيح لها ما هو غير ممكن عادةً في ظل التشريعات المحلية النافذة بهدف التوافق مع المناخ التشريعي العالمي المتغير, وبما لا يتعارض في الوقت ذاته مع السياسة الاقتصادية العليا للدولة المضيفة, بل بما ينسجم مع (ويحقق) سياسة هذه الدولة في تشجيع الاستثمارات الأجنبية والمحلية. ومن خلال دراسة تحليلية مقارنة باستقراء نشوء وتطور وتشريعات وتجربة بعض المناطق الحرة في الدول العربية المجاورة من جهة, وسبر تجربة المناطق الحرة السورية من الجهة الأخرى, يتوصل البحث إلى توصيف الثغرات والمعوقات التي يمكن الانطلاق منها لوضع الحلول والمقترحات المناسبة لتطوير وتفعيل العمل الاستثماري في المناطق الحرة السورية .

This research deals with a vital subject related to the "General Establishment of Free Zones in Syria " which has developing and investing characteristics .Generally,  free zones are the entrance gates of the national economies , in addition to their role in attracting foreign investments , and catalyzing development of certain economic sectors . From the customs point of view , the free zone is a " Foreign Land " , therefore , its function is governed by global competition and market economy .At the same time , they should serve the objectives of the host country's economic policy in encouraging national and foreign investments . Using analytical and comparative approach and reviewing the historical growth, development, legislations and experiments of  free zones worldwide, in general, and in Syria in particular , this study seeks describing obstacles and gaps to reach suitable solutions and recommendations for developing and activating investments in Syrian free zones .
