رقابة القضاء العادي لشرعية القرارات الإدارية دراسة مقارنة (سوريا، مصر، فرنسا)

Abstract

إن الاتجاه للأخذ بنظام القضاء المزدوج، وبروز القضاء الإداري كقضاء مختص للنظر في المنازعات الإدارية، واستئثاره بالفصل في تلك المنازعات لم يحل دون قيام القضاء العادي بممارسة دوره في حماية وصون مبدأ المشروعية، وقيامه بالرقابة على القرارات غير المشروعة، وإن اقتصرت تلك الرقابة على رقابة الامتناع، فهي وفي جميع الأحوال تحول دون مساهمة القضاء العادي في تطبيق نص غير شرعي، كما تحول دون التأخر في تطبيق النص القانوني وتحقيق العدالة. The trend of taking the dual judiciary system and the emergence of the administrative judiciary ، specialist to look at the administrative disputes، did not prevent the normal judiciary to exercise its role in the protection and preservation of the principle of legality and its control over the illegal resolutions and such limited control over the control of abstinence preclude the contribution of the normal judiciary in the application of illegal text ، and the late application of the legal text and justice .
