Abstract

This research addresses the topic of international criminal responsibility for the use of internationally prohibited weapons, as it is one of the most important topics within the framework of international criminal law, given the suffering, dangers, and damages that the whole world has endured from the use of unconventional weapons in wars, and the threats that their use may cause that could occur at any time and place in the present and future. This keeps the door always open for various researchers to investigate this thorny and sensitive topic.

         This research necessitated addressing the elements of international criminal responsibility for the unlawful use of internationally prohibited weapons in the first section, and the circumstances under which international criminal responsibility for the use of such weapons is negated in the second section.

          In the first section, we discussed the elements of international criminal responsibility, namely: the objective element, represented by the unlawful conduct, and the element of personal attribution. In the second section, we addressed the circumstances under which international criminal responsibility is negated arising from the use of internationally prohibited weapons, whether through the materials used in their manufacture or through the use of the weapons themselves.
